Selling your property
In order to ensure a smooth transaction when selling your property it is even more important for you to consult us as soon as you decide to sell.
There are three Property Information Forms (four in the case of Leasehold
properties) which have to be filled in giving comprehensive information
about the property. At this stage it is useful to establish whether any
documents have to be obtained from third parties, for example planning
documents from the Local Authority.
Pre-exchange
Once you have accepted an offer on your property and we have received the details from the Estate Agents we are usually able to draft the contract and send it out within a few days.
Leasehold
If you are selling a flat, the delaying aspect of most transactions is often obtaining information from the managing agents / freeholders, e.g. that all ground rent and service charge has been paid, details of service charge for the past few years and major works intended for the future, details of the buildings insurance.
Exchange of the Contract
We will promptly deal with any enquiries that your buyer’s solicitors may make but these will probably require your assistance as they often deal with matters outside strictly legal questions (e.g. services to the property, relations with neighbours, alterations you may have made to the property).
When the terms of the contract have been agreed, we will send you the seller’s part
of the contract to be signed and as soon as the chain is ready and a completion date is agreed and you confirm to us you wish to go ahead, we will commit you to the sale.
If you are buying a property at the same time, we will of course coordinate the two transactions so that you do not find yourselves with either two homes or no home at all.
Between Exchange and Completion
Once the contract has been exchanged and a completion date agreed, you can start to make plans to move. During this intervening period we will obtain a statement from your mortgage lenders detailing how much you need to pay back on completion. We will also send you various documents to sign and a statement showing all the receipts and payments in the transaction and consequently the balance due to you on completion
or available to be put towards your purchase.
Completion
On the day of completion we will be in touch with you every few hours to
reassure you and to advise you when you may expect either to receive the keys of the new property or the money if you are selling
alone. We will discharge your mortgage and pay the estate agents.
